1. AGREEMENT

   ("Bonzoi") is a web and downloadable service featuring the debut ("BragBook") Author provided by Websistant, LLC. These Terms of Service ("TOS") constitute an agreement that you accept at the time you register, renew, or revise your Account, or accessing our Site and viewing its Content. Use of the services and registration to be a member for the services provided by the Website is void where prohibited. By using the Website, you represent and warrant that (a) you are 13 years of age or older; and (b) your use of the Website does not violate any applicable law. Your membership and future use of the Website may be terminated without warning, if we believe that you are under13 years of age.

2. GENERAL TERMS

   A. You agree to the terms and conditions (the "Terms of Service") when using and /or visiting this website or any websites linked to WWW.BONZOI.COM ("Website"). Websistant, LLC may, in its sole discretion, modify or make additions to these Terms of Service at any time, and you agree to be bound by such modifications or additions. B. These Terms of Service apply to all users of the Website, including users who contribute video content, information, and other materials or service. C. Websistant, LLC does not provide any warranty or guarantee as to the accuracy, completeness, or suitability of the information and materials found or offered on the Website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and Websistant, LLC expressly excludes liability for any such inaccuracies or errors to the fullest extent permitted by law. D. The Website may contain links to third party websites that are not owned or controlled by Websistant, LLC. Websistant, LLC assumes no responsibility for the content, privacy policies, or practices of any third party websites. You expressly relieve Websistant, LLC and its affiliates from any and all liability arising from your use of any third-party website.

3. PARTICULAR TERMS – Websistant, LLC's ("Bonzoi") & ("BragBook") Terms:

   A. Any user may utilize the ("BragBook") Author on the ("Bonzoi") network to design a user defined digital and interactive web-based e-Book file including but not limited to images, text, sound recording, video, illustrations and authoring between the ranges of a personal journal or school yearbook or school yearbook to an interactive and digital graphic novel or more commonly depicted as a comic book. The ("BragBook") Author however, is only a vehicle of transport for the intellectual properties of only authorized member(s)/representative(s)/author(s) of the ("Bonzoi") network. B. The intellectual properties or content posted to the ("Bonzoi") network or through the ("BragBook") Author is not public information until it is release by the authorized member(s)/representative(s)/author(s). C. If your content is shared information with user(s) within the ("Bonzoi") network or outside; we highly suggest that you obtain their consent in writing and in advance of creating and publishing your respective files. If you are the one collecting their information, we highly suggest that you post a privacy policy explaining what information you collected and how you plan to use it. D. Third-party advertisements which have not received consent from Websistant, LLC are not prohibited within the ("BragBook") Author. E. You must comply with all applicable laws and these TOS, including all terms of service identified herein. F. You may not establish terms beyond those set forth in these terms to govern the posting of content by users on the ("Bonzoi") network or in the ("BragBook") Author.

4. USE OF CONTENT ON THE SITE

   The following conditions apply to your use of content on the ("Bonzoi") Website: A. The content on the Website, except all User Submissions , including without limitations, the text, software, yearbooks, scripts, animations, illustrations, film strips, comic productions, fine art representations, graphics, photos, sounds, music, videos, ("BragBook(s)"), interactive features ("Content") and the Trademark(s), Service Mark(s) and Logo(s) contained therein ("Marks"), are owned by or licensed to Websistant, LLC, subject to copyright and other intellectual property rights under the law. Content on the Website is provided to you "AS – IS" for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. Websistant, LLC reserves all rights not expressly granted in and to the Website, its intellectual properties, and the content. B. You may access User Submissions solely for your information and personal use. It is your responsibility to ensure that any information or services available through this website meet your specific needs and/or requirements. C. You must not engage in the legal or illegal use, copying, or distribution of any Content, including but not limited to, any use, copying, or distribution of User Submissions obtained through the Website for any commercial purposes. D. You understand that when using the ("Bonzoi") Website, you will be exposed to User Submissions from a variety of sources, and that Websistant, LLC is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submissions. We only highly suggest that you protect your intellectual property rights; however we of Websistant, LLC cannot guarantee any of the above. You further understand and acknowledge that you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Websistant, LLC and agree to indemnify and hold Websistant, LLC, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site.

5. USER'S SUBMISSIONS CONDUCT AND CONTENT

   A. You may upload or submit any of the above approved "Content". These contents are collectively named "Submissions" or "User Submissions." You understand that whether or not such user Submissions are published, Websistant, LLC does not guarantee any confidentiality with respect to any Submissions. B. You shall be solely responsible for your own User Submissions. You affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use and authorize Websistant, LLC to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these TOS. C. You further agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Websistant, LLC all of the license rights granted herein. D. Websistant, LLC does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and Websistant, LLC expressly disclaims any and all liability in connection with User Submissions. Websistant, LLC does not permit copyright infringing activities and infringement of intellectual property rights on its Website, and Websistant, LLC will remove all content and User Submissions if properly notified that such content or User Submission infringes on another's intellectual property rights. Websistant, LLC reserves the right to remove content and User Submissions without prior notice. E. Websistant, LLC reserves the right to reject, refuse to publish, or delete any User Submissions including but not limited to the content.

6. PRIVACY POLICY (click to see entire privacy policy)

   ENFORCEMENT Websistant, LLC regularly reviews its compliance with this Privacy Policy. When we receive formal written complaints, it is Websistant, LLC's policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between Websistant, LLC and an individual. CHANGES TO PRIVACY POLICY The privacy policy as well as the updates which include security feature updates will notify the user that if they do not want to confirm or accept the policy changes they will have to log out and the when they choose to read and accept the new policy terms, they may do so and gladly sign in. reading is not necessary as all security and policy measures are taken to protect all the users on the ("Bonzoi") network or users of the ("BragBook") Author. These and above Privacy Policy update procedures may take change from time to time. We will post any changes in our respective fashion as well but not limited to keeping prior version in our archives. IDENTITY THEFT If you believe that you are a victim of identity theft you are entitled by law to request information from us, write us at our address below and we will let you know what additional information you must provide to us. After we have received that information, we will supply without charge the information legally required to be disclosed that we then have, subject to applicable law and reserving all of our rights and defenses. 7. PASSWORDS

   You are responsible for safeguarding the password that you use to access the website and for any activities or actions under your password. Websistant, LLC cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

8. WARRANTY

   YOU AGREE THAT YOUR USE OF THE WEBSITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WEBSISTANT, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE AND YOUR USE THEREOF. 9. LIMITATION OF LIABILITY

   IN NO EVENT SHALL WEBSISTANT, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE, (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (5) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (6) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. YOU SPECIFICALLY ACKNOWLEDGE THAT WEBSISTANT, LLC SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

10. INDEMNITY

    You agree to defend, indemnify and hold harmless Websistant, LLC, its subsidiary corporations, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses including but not limited to attorney's fees arising from: (a) your use of and access to the Website; (b) your violation of any term of these Terms of Service; (c) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (d) any claim that one of your User Submissions caused damage to yourself or a third party. This defense and indemnification obligation will survive these TOS and your use of the Website

11. SERVICE AVAILABILITY

    If the service becomes unavailable, we will make a commercially reasonable effort to restore the service within a reasonable period of time.

12. MISCELLANEOUS

    If any portion of any provision of the Terms of Service is found to be invalid, the provision shall be deemed deleted as if it were never part of this TOS, but all other provisions and remaining portions of any provision, which are valid, shall continue in full force. The parties agree that the substantive law of the State of California shall govern the Terms of Service (TOS) and all actions related to it. By using the Website you expressly consent to the personal jurisdiction of the State or Federal Courts located in Los Angeles, California with respect to any dispute arising out of the TOS or your use of the Website.

13. ABILITY TO ACCEPT TERMS OF SERVICE

    You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and /or are over the age of 13 and you are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these TOS, and to abide by and comply with these TOS.

14. NOTICES

    You agree that any notices we send to you in relation to your use of the service generally and to these TOS specifically may be sent via email to the address we have on file for your Account. You further agree that, with respect to changes we may make to these TOS, we may notify you either by sending an email or otherwise by posting a notice on the home page of the Website. You are responsible for keeping the contact information in your Account current based on your acceptance of any of the above terms.

WWW.BONZOI.COM is a service provided by Websistant LLC. All privacy settings and security features are measurements taken for the safety of all members on entire Bonzoi network.

When using this Website you consent to the collection, transfer, manipulation, storage, disclosure and other uses of your information. Your information may be used by Websistant, LLC in the United States or any other country where Websistant, LLC operates.

SECURITY

Security Measures:

Please note that e-mail is not encrypted and is not considered to be a secure means of transmitting confidential information. However, neither people nor security systems are foolproof, including encryption systems. In addition, people can commit intentional crimes, make mistakes or fail to follow policies. Therefore, we cannot guarantee its absolute security.

User Obligations:

You must protect against unauthorized access to your password and to your computer.

You must not violate any third party's intellectual property rights or other proprietary rights or contractual rights;

You must not post, email or make available any content that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

INFORMATION USE & COLLECTION:

We collect the following information:

Information – When you sign up for a Bonzoi Account, you provide some personal information, such as your name, email, gender and birth date. You will also be able to add a picture of yourself. In some cases we may ask for additional information for security reasons or to provide specific services to you. Once you register you can provide other information about yourself. Because of the way we maintain certain services, after you delete your information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems. If you do not want us to store data associated with content you share on Bonzoi, please remove the data before uploading the content.

Site Activity. We keep track of the actions you take on Bonzoi, such as adding connections, creating a photo album, creating a BragBook, creating a yearbook and digitally share, publishing a collaborative newsletter, creating subscriptions or connecting with an application.

Access and Information. When you access Bonzoi from a computer, mobile phone, or other device, we may collect information from that device about your browser type, location, and IP address, as well as the pages you visit.

Public Information: Our Services are primarily designed to help you share information with the world. Most of the information you provide to us is information you are asking us to make public. You should be careful about all information that will be made public.

Location Information: You may choose to note your location in your Bonzoi profile.

Cookies – When you visit Bonzoi, we send one or more cookies to your computer or other device. We use cookies to improve the quality of our service, including for storing user preferences, improving search results and ad selection, and tracking user trends, such as how people search. . A cookie is a small data file that is transferred to your computer's hard disk. Bonzoi also uses cookies in its advertising services to help advertisers and publishers serve and manage ads across the Web. You can instruct your browser, by editing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit.

Log Information – When you access Bonzoi our servers automatically record certain information. These server logs may include information such as your web request, your interaction with a service, Internet Protocol address, browser type, browser language, the referring domain, pages visited and search terms, the date and time of your request and one or more cookies that may uniquely identify your browser or your account.

User Communications – When you send email or other communications to Bonzoi, we may retain those communications in order to process your inquiries, respond to your requests and improve our services. We may collect and maintain information associated with such messages, the phone number, the wireless carrier associated with the phone number, the content of the message, and the date and time of the transaction. We may use your email address to communicate with you about our services.

Affiliated Bonzoi Services on other Sites – We offer some of our services on or through other websites. Personal information that you provide to those sites may be sent to Bonzoi in order to deliver the service. We process such information under this Privacy Policy.

Third Party Applications – Bonzoi may make available third party applications, such as gadgets or extensions, through its services. The information collected by Bonzoi when you enable a third party application is processed under this Privacy Policy. Information collected by the third party application provider is governed by their privacy policies.

Application Number – Certain service, include a unique application number that is not associated with your account or you. This number and information about your installation may be sent to Bonzoi when you install or uninstall that service or when that service periodically contacts our servers.

Other Sites – This Privacy Policy applies to Websistant, LLC services only. We do not exercise control over the sites displayed as search results, sites that include products or services, or links from within our various services. These other sites may place their own cookies or other files on your computer, collect data or solicit personal information from you.

In addition to the above, we use the information we collect to:

Provide, maintain, protect, and improve our services and develop new services; and Protect the rights or property of Websistant, LLC or our users.

If we use this information in a manner different than the purpose for which it was collected, then we will ask for your consent prior to such use.

INFORMATION SHARING

Websistant, LLC only shares personal information with other companies or individuals outside of Bonzoi in the following limited circumstances:

We have your consent.

We provide such information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information in compliance with this Privacy Policy.

We belief that access, use, preservation or disclosure of such information is reasonably necessary to:

• (a) satisfy any applicable law, regulation, legal process or enforceable governmental request,
• (b) enforce applicable terms and conditions, including investigation of potential violations thereof,
• (c) detect, prevent, or otherwise address fraud, security or technical issues, or
• (d) protect against harm to the rights, property or safety of Websistant, LLC, its users or the public as required or permitted by law.

If Websistant, LLC becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, we will ensure the confidentiality of any personal information involved in such transactions and provide notice before personal information is transferred and becomes subject to a different privacy policy.

CHILDREN UNDER 13

Our Services are not directed to people under 13. If you become aware that your child has provided us with personal information without your consent please contact us at websistant@gmail.com. If we become aware that a child under 13 has provided us with personal information, we take steps to remove such information and terminate the child's account.

No Information from Children under age 13. If you are under age 13, please do not attempt to register for Bonzoi or provide any personal information about yourself to us. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible.

Parental / Legal Guardian Participation. We strongly recommend that minors 13 years of age or older ask their parents or legal guardians for permission before sending any information about themselves to anyone over the Internet and we encourage parents to teach their children about safe internet use practices.

ENFORCEMENT

Websistant, LLC regularly reviews its compliance with this Privacy Policy.
